Attorneys for a self-help author set to be sentenced next month for the deaths of three people following an Arizona sweat lodge ceremony are asking a judge to delay that decision.
The request from James Arthur Ray’s defense team came a day after the judge pushed back the mitigation hearing and the sentencing date because defense attorney Tom Kelly suffered a heart
condition. Sentencing is Oct. 6.
The defense says it’s unclear whether Kelly can proceed as the lead attorney for the sentencing phase.
Ray’s attorneys further argued that two of them have scheduling conflicts, as do some of the witnesses set to testify in support of Ray during next week’s mitigation hearing.
Prosecutors say they want Ray sentenced before the two-year anniversary of the ceremony he led near Sedona.
